Critiques from Congress: House Select Committee on China Chair’s Response to New BIS Controls.

This morning, December 9th, 2024, Chairman John Moolenaar, R-Mich, of the House Select Committee on China released a letter to Gina Raimondo, Secretary of the U.S. Department of Commerce. The letter critiques the U.S. Department of Commerce’s Bureau of Industry and Security (BIS) for its export control rules on advanced semiconductor technology to China. While acknowledging positive steps, such as adding certain Huawei facilities to the Entity List and controlling high-bandwidth memory (HBM) technologies, the letter highlights significant loopholes enabling PRC entities to access U.S. technology. Examples include inconsistent licensing policies for Semiconductor Manufacturing International Corporation (SMIC) and carve-outs for Huawei affiliates. The letter calls for stronger counter-diversion measures, closure of loopholes, and preservation of related documents to ensure better oversight and protection of U.S. national security.
